Welcome to Music Academy Cafe (“Music Academy Cafe”, “we”, “us”, “our”). These Terms & Conditions (“Terms”) govern your access to and use of our website/storefront and any purchases of digital songs, music lessons, and catering services (collectively, the “Services”).

By using our site or placing an order, you agree to these Terms.

2) Definitions

Digital Content: downloadable or access-based music/audio files (e.g., songs, backing tracks, recordings, digital bundles).

Lessons: in-person or online music lessons, classes, workshops, or coaching sessions.

Catering: prepared food and beverages for events, delivery, pickup, and/or on-site service (if offered).

Order: your purchase request submitted through our checkout or booking flow.

3) Eligibility & Account

You must be able to form a legally binding contract to purchase from us.

If you create an account, you are responsible for keeping your login details secure and for all activity under your account.

We may refuse service, suspend accounts, or cancel orders if we reasonably believe there is fraud, abuse, or a violation of these Terms.

4) Pricing, Payment & Taxes

Prices are shown on our store and may change at any time.

Any applicable taxes, service charges, delivery fees, or processing fees will be shown at checkout (where applicable).

Payment must be received in full (or by required deposit) before we deliver Digital Content, confirm Lessons, or confirm Catering.

5) Orders, Confirmations & Cancellations (General)

Your order is only confirmed when you receive our order confirmation (email/receipt) or booking confirmation.

We may cancel or limit orders in cases of suspected fraud, incorrect pricing, stock/availability errors, or technical issues. If we cancel after you’ve paid, we will refund the amount paid for the canceled portion.

DIGITAL SONGS / DIGITAL CONTENT

6) Delivery of Digital Content

Digital Content is delivered electronically (e.g., download link or account access).

You are responsible for having compatible devices/software and stable internet access.

If you have trouble accessing a download, contact us and we’ll assist with reasonable troubleshooting and re-delivery where possible.

7) License & Usage Restrictions

Unless stated otherwise, Digital Content is licensed—not sold—to you on a personal, non-exclusive, non-transferable, non-sublicensable basis for private, non-commercial use only.

You must not:

  • resell, redistribute, share, upload, broadcast, or publicly perform Digital Content without permission;
  • remove watermarks/metadata or attempt to bypass access controls (if any);
  • use Digital Content in commercial projects (ads, monetized videos, public events, client work) unless you have written permission or a separate commercial license.

8) Digital Refund Policy

Because Digital Content can be copied once delivered, all sales of Digital Content are generally final once:

  • a download link is accessed, or
  • access is granted.

However, we may offer a refund or replacement at our discretion if:

  • the file is defective/corrupted, or
  • the wrong item was delivered, and we cannot reasonably fix it.

MUSIC LESSONS

9) Booking & Lesson Details

Lessons may be offered in-person at our HQ, online, or at another agreed location (if applicable).

Lesson duration, package validity, and included materials (if any) will be shown during booking or in your receipt.

10) Rescheduling, Late Arrivals & No-Shows

Unless your booking confirmation states otherwise:

Rescheduling: Requests should be made at least 24 hours before the lesson start time. Approval is subject to teacher/studio availability.

Late arrival: Lesson time may be reduced to keep schedule fairness; fees remain the same.

No-show: Missed lessons without notice may be treated as used and not refundable.

11) Teacher Changes & Cancellations by Us

We may substitute teachers or reschedule due to illness, emergencies, or operational needs.

If we cancel and cannot reschedule, we will offer a make-up lesson or refund for the affected session(s).

12) Lesson Materials, Recording & Conduct

Any lesson notes, recordings, arrangements, or materials we provide are for the student’s personal use unless stated otherwise.

Recording lessons may be allowed or restricted depending on the teacher/class; please follow the instructions given at the session.

Respectful behavior is required. We may end a session without refund for harassment, unsafe behavior, or repeated disruption.

13) Minors

If the student is under 18, a parent/guardian must:

  • consent to the booking and these Terms, and
  • be responsible for the minor’s conduct and supervision requirements (especially for in-person lessons).

CATERING SERVICES

14) Catering Quotes, Orders & Deposits

Catering availability depends on date, capacity, and service area.

A catering order is confirmed only after we provide written confirmation (email/receipt) and receive any required deposit or full payment.

Menu items may be subject to seasonal availability and may be substituted with comparable items if needed (we’ll inform you where reasonable).

15) Changes, Headcount & Final Confirmation

Changes to menu, quantities, delivery time, or event details must be requested in advance and may incur additional charges.

Final headcount/menu confirmation deadlines (if any) will be communicated at booking/confirmation.

16) Delivery, Setup & Client Responsibilities

If delivery/setup is included:

  • You must provide accurate address details and ensure access (parking, lift access, entry permissions).
  • Delays caused by incorrect details or inaccessible locations may result in additional fees or reduced service time.

If self-pickup is selected:

  • Pickup timing must be followed to maintain food quality and safety.

17) Allergies & Dietary Requirements

Please notify us of all allergies and dietary restrictions when placing your order.

While we take care, our kitchen may handle common allergens (e.g., nuts, dairy, eggs, gluten, seafood). We cannot guarantee a completely allergen-free environment unless expressly agreed in writing.

18) Cancellations & Refunds for Catering

Catering involves preparation and ingredient procurement. Unless your confirmation states otherwise:

Cancellations close to the event date may be non-refundable or partially refundable depending on costs already incurred.

We will inform you of any applicable cancellation charges at the time of cancellation request.

19) Promotions, Vouchers & Store Credit

Promo codes/vouchers are subject to stated terms (expiry, usage limits, excluded items).

We may refuse vouchers obtained fraudulently or used in violation of stated rules.

20) Intellectual Property

All website content, branding, logos, lesson materials, menus, photos, audio, and Digital Content are owned by or licensed to Music Academy Cafe and are protected by intellectual property laws. You may not use them beyond what is allowed in these Terms without written permission.

21) User Content & Reviews

If you submit reviews, comments, or media:

you grant us a non-exclusive right to display and use it for store operations and marketing (unless you request removal where reasonable);

you confirm it is your own content and does not violate anyone’s rights.

22) Disclaimers

We aim to provide accurate listings, but we do not guarantee that descriptions, images, or availability are error-free.

Lessons are educational services; individual results vary based on practice and other factors.

Catering food quality is best within recommended time windows; storage/handling after delivery/pickup is your responsibility.

23) Limitation of Liability

To the maximum extent permitted by law, Music Academy Cafe will not be liable for indirect, incidental, special, or consequential damages (including loss of profits or data). Our total liability for any claim related to an order will not exceed the amount you paid for the specific product/service giving rise to the claim.

24) Indemnity

You agree to indemnify and hold Music Academy Cafe harmless from claims, damages, and expenses arising from your misuse of the Services, violation of these Terms, or infringement of third-party rights.

25) Privacy

Your personal data will be handled according to our Privacy Policy (published on our site). If you don’t have one yet, you should add a Privacy Policy page describing what data you collect, why, how it’s stored, and how customers can request access/deletion.

26) Governing Law & Disputes

These Terms are governed by the laws of Malaysia. Any disputes will be handled in the courts of Malaysia, unless mandatory consumer protection rules apply otherwise.

27) Changes to These Terms

We may update these Terms from time to time. Changes take effect when posted on our website with an updated “Last updated” date.
